Official Rules: Yahoo! Hack Days Contest
THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA (COLLECTIVELY, THE "ELIGIBILITY AREA") AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO THE LAWS OF THE UNITED STATES. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED AND LEGALLY RESIDING IN THE ELIGIBILITY AREA DURING THE ENTIRE TERM OF THIS CONTEST. SEE BELOW FOR ADDITIONAL ELIGIBILITY RESTRICTIONS.
NO ENTRY FEE OR PURCHASE IS REQUIRED TO PARTICIPATE OR WIN.
ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THE TERMS OF THESE OFFICIAL RULES.
About The Contest: The Yahoo! Hack U Contest (the "Contest") is a contest in which Yahoo! is seeking creative software applications ("Hacks") developed by students at select schools across the US. During the first round of the Contest, regional events will be held at colleges around the United States (each, a "Regional Event") in which first round winners will be selected. A second round of judging will take place among the winners of each Regional Event at Yahoo!'s headquarters or another Sponsor-determined location in 2012.
Eligibility: This Contest is open to legal residents of the fifty United States, the District of Columbia who: a) are 18 years of age or older, b) are actively enrolled as a student at one of the educational institutions listed below, and c) otherwise meet all eligibility requirements in these Official Rules. Entries may be submitted by individuals or teams of up to 4 (four) participants (each, a "Team") provided that all members of the Team individually meet the eligibility criteria defined above and agree to comply with these Official Rules. The team or a team member must be able to make a 5 minute presentation at the Hack U event on the date specified for your school below. Projects submitted in connection with an entry in this Contest must likewise meet all submission criteria set forth in these Official Rules in order to be considered. Employees and agents of Yahoo! Inc. ("Sponsor"), participating media outlets, and each of their respective affiliates, subsidiaries, advertising and promotional agencies, any other prize sponsor, and any entity involved in the development, production, implementation, administration or fulfillment of the Contest (all of the foregoing, together with Sponsor, collectively referred to as "Contest Entities"), and the immediate family members and persons living in the same households as such individuals, whether related or not, are not eligible to participate or win. Void in overseas U.S. territories, possessions, commonwealths and military installations, and where prohibited by law.
Contest Phases: The Contest consists of two phases:
Entry Period: The Contest begins at 12:00 am PT on February 23rd, 2012 and ends at 11:59 pm PT on April 30th , 2012; however, each school below has a twenty-four (24) hour entry period, which is provided below. If you are an individual or Team who fully complies with the eligibility requirements described above, you may enter the Contest by visiting the Hack U website located at http://www.developer.yahoo.com/hacku (the “Contest Website”) and entering your submission during the 24 hour window specified below for your school. You must follow the instructions to submit an Entry Form and your Hack URL ("Hack URL"). Collectively, the Entry Form and Hack URL are referred to in these Rules as a "Contest Entry". You will be asked to provide your name, Yahoo! ID, email address, the name of your Hack, the names of your Team members, as applicable, and which of the Team members will be presenting the Hack in the Contest, if applicable. Follow the instructions to properly submit the Entry Form. When you have completed your Hack, you must return to the Contest Website and provide the URL where the completed Hack may be viewed by the Contest judges by the time stated on the date of the applicable deadline for each Regional Event listed below.

All Entry Materials become the property of Sponsors and will not be returned, however you retain any IP associated with your Hack submission. For the purposes of this Contest and these Official Rules, "receipt" of a Contest Entry occurs upon proper completion and submission of the Entry Form and the proper submission of the Hack URL. Any automated computer receipt (such as one confirming delivery of email or a "thanks for entering" message) does not constitute proof of actual receipt of a Contest Entry by Sponsors. The Contest Entities assume no responsibility for advising an entrant of an incomplete or otherwise non-compliant submission. Late, unintelligible, incomplete, mutilated or garbled entries will be disqualified.
First Round Judging: The eligible Entries properly received for each Regional Event will be reviewed at the Regional Event in a first round of judging by a panel consisting of a panel of Yahoo! engineering staff (the "First Round"). Each Contest Entry will be demonstrated in a 5-minute presentation before the judges by the Contest entrant or, in the case of a Team entry, by a member of the Team. The Regional Event venue will provide a display screen and an internet-connected demonstration machine. In the event that more than 50 entries are received in connection with any Regional Event in this Contest, Sponsor reserves the right to extend the First Round judging period so that all eligible Entries may be judged properly. Each Entry's score will be based on the following criteria, which will be weighted evenly: (i) Problem Definition (How well is problem defined); (ii) Creativity of the Hack; (iii) Difficulty of Problem Being Addressed; (iv) Presentation of Hack to Judges.
The top three Entries at each Regional Event based on the above criteria will be named as the First, Second and Third Place winners for that Regional Event and will win the Regional Prizes listed below. In addition, the top scoring Entry at each Regional Event will be named as a finalist (a "Finalist") and will go on to the next phase of the Contest, subject to verification. In the event of a tie in the First Round, the tied Entries will both go on to the Second Round. The judges reserve the right to select some or no Finalists if they determine, in their sole opinion, that there are an insufficient number of eligible, complete, tasteful, or appropriate Entries. Each potential Finalist, including all members of any Team named as a Finalist, will be required to execute and return an Affidavit of Eligibility and a Liability and Publicity Release (collectively, an "Affidavit and Release"). As part of the Affidavit and Release, each potential Finalist will be required to give his/her permission for the Sponsor to seek, at its option, a background check from an outside source. Failure to give approval will result in disqualification of the potential Finalist from the Contest, and may result in disqualification of that Finalist's Team from further competition. Sponsor reserves the right, in its sole discretion, to disqualify any potential Finalist or confirmed Finalist on the basis of that individual's investigative reports. The Affidavit and Release must be fully completed and returned to Sponsor within 30 days following the sending of those documents to the potential Finalist, or the potential Finalist may be disqualified. As with the initial judging criteria, the judges reserve all rights to select fewer than six Finalists if fewer than six of the potential Finalists are judged to meet their criteria, or if any potential Finalist, in the sole opinion of the Sponsor, does not pass a background check.
Second Round Judging: After the conclusion of the First Round, the Finalists will go on to a second round of judging (the "Second Round"). The Second Round is currently expected to be held at Yahoo!'s headquarters in Sunnyvale, CA, in fall 2012. In the event that the Second Round is extended or cancelled, notice will be posted on the Contest Website and winners will be notified. In the Second Round, the six Finalists from the previous phase will be judged by a different panel of judges selected by the Sponsor. As in the First Round Judging, each Contest Entry will again be demonstrated in a 3-5 minute presentation before the judges by the Contest entrant or, in the case of a Team entry, by a member of the Team. Judging will be conducted using the same criteria and weighting used in the First Round. Similarly, the judges reserve the right to select some or no Finalists if they determine, in their sole opinion, that there are an insufficient number of eligible, complete, tasteful, or appropriate Entries. There is no official prize for the Second Round of this Contest.
General Conditions of Entry: By entering the Contest, each entrant:
agrees to be bound by these Official Rules, which will be posted at the Contest Website throughout the Contest, and acknowledges that failure to comply with these Official Rules will result in disqualification from the Contest;
agrees to comply with and be bound by the decisions of the Sponsor and the judges relating to this Contest, which shall in each case be final and binding in all respects;
WARRANTS AND REPRESENTS THAT THE ENTRANT OWNS ALL RIGHTS TO THE ENTRY HE/SHE IS SUBMITTING, INCLUDING, WITHOUT LIMITATION, ALL CONTENT, INCLUDING BUT NOT LIMITED TO IMAGES, TEXT, OR OTHER COPYRIGHTABLE MATERIAL, TRADEMARKS, SERVICE MARKS, LOGOS OR ANY OTHER INTELLECTUAL PROPERTY CONTAINED WITHIN THE ENTRY URLS (COLLECTIVELY, THE "ENTRY MATERIALS"), AND CAN PROVIDE WRITTEN CONFIRMATION OF ANY OF THE ABOVE UPON REQUEST;
WARRANTS AND REPRESENTS THAT: (i) HIS/HER ENTRY MATERIALS ARE ORIGINAL AND HAVE BEEN LEGALLY OBTAINED AND CREATED, AND DO NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY; (ii) THE ENTRY MATERIALS HE/SHE IS SUBMITTING ARE NOT CURRENTLY UNDER CONSIDERATION FOR ANY OTHER AWARD, CONTEST, OR PROMOTION; (iii) HE/SHE WILL NOT OTHERWISE SUBMIT THE ENTRY MATERIALS TO ANY OTHER ENTITY FOR ENTRY IN A COMPETITION OR PROMOTION FOR A PERIOD OF ONE YEAR AFTER THE CONCLUSION OF THE CONTEST PERIOD; and
grants to Sponsor and its affiliates, legal representatives, assigns and licensees, the right and permission to copyright (as appropriate), reproduce, encode, store, copy, transmit, publish, broadcast, display, publicly perform, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the entrant's name, address, image, voice, likeness, statements, biographical material and Entry Materials (in each case, as submitted or as edited by Sponsor, in Sponsor's sole discretion), as well as any additional photographic images, video images, portraits, interviews or other materials relating to the entrant and arising out of his/her participation in this competition (with or without using the entrant's name) (collectively, the "Additional Materials") in any media throughout the world for advertising and publicity purposes without additional review, compensation, or approval,
understands that the Sponsor may currently or in the future be developing products, services, concepts, systems, methods or techniques internally, or receiving information from other parties that may be similar to the Entry Materials. Sponsor's receipt of Entry Materials will not prohibit or in any way limit the Sponsor from developing (or having developed for it) products, services, concepts, systems, methods or techniques that are similar to or compete with the products, concepts, systems, methods or techniques contemplated by or embodied in the Entry Materials;
agrees to indemnify and hold the Contest Entities and their respective subsidiaries, affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Contest Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Indemnities due to or arising out of the entrant's Entry Materials or Additional Materials in this Contest, or the entrant's conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy and defamation.
Regional Prizes: At each Regional Event, the following prizes will be awarded to the three highest scoring Entries:
First Prize: One (1) First Prize winner (each team member if the winner is a Team) will receive an Ipad (retail value: $500) based on availability, which will be presented onsite or mailed to the winner. In addition, each First Prize winner at each Regional Event (for a total of 4 First Prize winners (or teams) in the Contest overall) will receive a trip for the Finalist, or, if a Team, the members of the Finalist Team to Yahoo!'s headquarters in Sunnyvale, CA to compete in the Second Round of the Contest. Prize package includes round trip air transportation between a major U.S. airport close to Finalist's home and San Jose, CA (carrier and airport to be selected by Sponsor; however, Sponsor reserves the right to offer ground transportation depending on winner's proximity to San Jose); standard hotel accommodations (for Finalist Teams, Team members may be required to share one or more rooms, at Sponsor's discretion) for 2 nights; round trip airport transfers to/from San Jose-area airport; and round trip transfers between hotel and Yahoo! headquarters. Approximate retail value of each First Prize: $2,000 per person (Prize value may vary depending on actual cost of airfare from point of departure, accommodations at time of reservation, and selection of electronic equipment).
Second Prize: One (1) Second Prize winner (or each team member) will receive a $100 Visa gift certificate or other prize of equal or greater value. (Retail Value: $100)
Third Prize: One (1) Third Prize winner (or each team member) will receive a Yahoo! promotional bag filled with Yahoo! swag. (Retail Value $75).
The following applies to the Regional First Prizes: Except as specifically provided herein, Regional First Prize packages do not include taxes, insurance, telephone charges, personal expenses, travel arrangements between winner's home and U.S. airport of departure, ground transportation, gratuities, passenger facility charges (PFCs), departure taxes, incidental charges, or any other item not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the prize winner. All events offered in connection with this Contest are subject to change and/or cancellation. Potential Finalists must be available for travel on dates specified by Sponsor, which will be confirmed at least 30 days prior to required travel dates. If Contest Entities cannot find a sufficient number of potential Finalists who able to travel on required dates in time to satisfy verification procedures, not all Regional First Prizes may be awarded. Once confirmed, trip dates and travel accommodations cannot be changed by winner; however, travel is subject to availability, blackout dates, and/or change due to circumstances beyond Contest Entities' control. Finalists from the same Team must travel on the same dates, itinerary, and fare class. All travel in this Contest must be completed by the day after the Second Round of judging. No extensions will be permitted, and any unused travel will be forfeited. All tickets issued in conjunction with Regional First Prizes are not eligible for frequent flyer miles, and no code-share flights may be used.
The following applies to all prizes: Approximate aggregate retail value of all prizes: $25,000. Prizes may not be transferred or assigned except by Sponsor. Prizes cannot be used in conjunction with any other promotion or offer and may not be separated. Any portion of a prize not used by a winner is forfeited. Only listed prizes will be awarded and no substitutions, cash equivalents or redemptions will be made, except that Sponsor reserves the right to substitute any prize or component of a prize package with another prize of equal or greater value for any reason. Sponsor will attempt to provide winners with prizes named, however, winners are not guaranteed to receive their first choice. All prizing details not provided in these rules are at Sponsor's sole discretion. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize are the sole responsibility of the winner of that prize. Contest Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the prizes awarded. Yahoo! makes no representations or warranties, whether express or implied, or in fact or in law, concerning the appearance, safety or performance of any prize awarded. Restrictions, conditions, and limitations apply. Contest Entities will not replace any lost or stolen prize items.
Winner Announcement: For Regional Events, potential Regional Event winners will be announced at the conclusion of the Regional Event; similarly, potential Grand Prize winner will be announced at an awards ceremony held on the evening of the Second Round Judging. Except where prohibited by law, potential winners must return any documentation or required documents requested by the Contest Entities in connection with Prize fulfillment within fourteen days following attempted notification or prize may be forfeited. Return of any prize/prize notification as undeliverable, or inability of Contest Entities to contact a potential winner may result in disqualification and selection of an alternate winner using the methods and ranking system described above.
Except where prohibited by law, a winner's acceptance of a prize constitutes permission for Sponsor to use such winner's name, address (city and state only), statements, photograph, voice and/or likeness for any advertising and promotional purposes relating to the Sweepstakes without further compensation, consideration, review or consent.
General Conditions: This Contest is governed by the laws of the United States and Ontario. All federal, state and local laws and regulations apply. All events presented in connection with this Contest are subject to change and/or cancellation.
Sponsor reserves the right at its sole discretion to disqualify the Entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any Yahoo! website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Yahoo! property or service, or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Further, Sponsors reserve the right to disqualify any Entry which, in Yahoo!'s sole opinion, is deemed to be offensive, disparaging to the Sponsor or otherwise portraying Sponsor in a negative manner, libelous, slanderous, inflammatory, or otherwise inappropriate in any way for this Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
By accepting a prize, each winner agrees to release and hold harmless Contest Entities, and their respective parents, companies, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind to persons, including but not limited to death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this Contest, or while traveling to, preparing for or participating in any prize-related activity.
Limitations of Liability: The Contest Entities assume no responsibility for any computer, online, telephone transmission or technical malfunctions that may occur during participation in the Contest, or for theft, destruction or unauthorized access to, or alteration of, Entry Materials. Contest Entities are not responsible for any incorrect or inaccurate information, whether caused by website users, Contest participants or any of the equipment or programming associated with or utilized in the Contest; or for any technical or human error which may occur in the processing of submissions in the Contest. Contest Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers, whether on account of technical problems, traffic congestion on the Internet or at any website, or on account of any combination of the foregoing (including but not limited to any such problems which may result in the inability to access the Contest Website or any website submitted in connection with an Entry in this Contest). Contest Entities are not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Contest Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select winners from among that portion of the Contest that has not been compromised, if any.
Winners List: The names of the Prize winners may be obtained between the date of winner selection (currently expected to be in April 2012) and no later than 90 days thereafter by sending a self-addressed stamped envelope to: Yahoo!
